Ayahuasca is a psychoactive beverage that is mostly used in ritualized settings (Santo Daime rituals, neo-shamanic rituals, and even do-it-yourself-rituals). It is a common practice in the investigated socio-cultural field to call these settings “healing rituals.” For this study, 15 people who underwent ayahuasca (self-)therapy for a particular disease like chronic pain, cancer, asthma, depression, alcohol abuse, or Hepatitis C were interviewed twice about their subjective concepts and beliefs on ayahuasca and healing. Qualitative data analysis revealed a variety of motivational (...) patterns, subjective effects, and user types. Most participants were convinced that ayahuasca had influenced their illness positively or improved their coping with their illness. More importantly, it had enhanced their well being in general. As a result, we concluded that the effects of ayahuasca should not be reduced to a pharmacological model. The substance should be conceptualized as a psychological catalyst that unfolds within different fields of sociocultural ideas. (shrink)

What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation. Algorithmic decision-making increasingly shapes people's daily lives. Given that such autonomous systems can cause severe harm to individuals and social groups, fairness concerns have arisen. A human-centric approach demanded by scholars and policymakers requires considering people's fairness perceptions when designing and implementing algorithmic decision-making. We provide a comprehensive, systematic literature review synthesizing the existing empirical insights on perceptions of algorithmic fairness from 58 empirical studies spanning multiple domains and scientific disciplines. Through thorough coding, we systemize the current empirical literature along (...) four dimensions: (1) algorithmic predictors, (2) human predictors, (3) comparative effects (human decision-making vs. algorithmic decision-making), and (4) consequences of algorithmic decision-making. While we identify much heterogeneity around the theoretical concepts and empirical measurements of algorithmic fairness, the insights come almost exclusively from Western-democratic contexts. By advocating for more interdisciplinary research adopting a society-in-the-loop framework, we hope our work will contribute to fairer and more responsible algorithmic decision-making. (shrink)

This paper describes the application of eight statistical and machine-learning methods to derive computer models for predicting mortality of hospital patients with pneumonia from their findings at initial presentation. The eight models were each constructed based on 9847 patient cases and they were each evaluated on 4352 additional cases. The primary evaluation metric was the error in predicted survival as a function of the fraction of patients predicted to survive. This metric is useful in assessing a model’s potential to assist (...) a clinician in deciding whether to treat a given patient in the hospital or at home. We examined the error rates of the models when predicting that a given fraction of patients will survive. We examined survival fractions between 0.1 and 0.6. Over this range, each model’s predictive error rate was within 1% of the error rate of every other model. When predicting that approximately 30°K of the patients will survive, all the models have an error rate of less than 1.5%. The models are distinguished more by the number of variables and parameters that they contain than by their error rates; these differences suggest which models may be the most amenable to future implementation as paper-based guidelines. This book critically assesses arguments for the existence of the God of classical theism, develops an innovative account of objects’ persistence, and defends new arguments against classical theism. The authors engage the following classical theistic proofs: Aquinas’s First Way, Aquinas’s De Ente argument, and Feser’s Aristotelian, Neo-Platonic, Augustinian, Thomistic, and Rationalist proofs. The aim of this paper is to get from a phenomenology of birth towards an ethics of obstetric care: Human rights violations in obstetrics are currently a globally debated phenomenon. Research suggests that maltreatment is widespread and a global phenomenon. However, the prevalence cannot yet be clearly quantified. In view of this problem, it is necessary to take the subjective perspective of those affected seriously. Narrative and phenomenological accounts of birth experiences could help to foster the dialogue between persons giving (...) birth and health professionals. First, I will present narrative accounts of birth experiences recorded by feminist phenomenologists. Second, I will interpret these narrative accounts within a feminist phenomenological framework in order to contribute to a phenomenology of birth, which, in a third step, shall help to develop an ethics of obstetric care. In engaging with the phenomenology of care outlined by feminist care ethicists, I will analyze the elements and conditions of good care, and draw conclusions for an ethic of obstetric and midwifery care. Drawing additionally on the theory of relational autonomy, my paper argues for a relational implementation of self-determination in childbirth. Lastly, I will discuss to what extent the ethical ideal of care has an affinity to the midwifery model of childbirth, and how the current situation of obstetrics prevents a women-centered birth culture. Houston, Texas, is a major U.S. city with, like many, a growing aging population. The purpose of this study and ultimate book chapter is to explore the views and perceptions of long-term care (LTC) residents, family members and health care providers. Individuals primarily in independent living and group residential settings were interviewed and studied. Questions emphasized the concepts of personal autonomy, dignity, quality and location of care and decision making. Although a small sample of participants were involved, consistency was noted. (...) Keeping the elderly in caring and loving home situations (theirs or family) was most preferred. Personal choice and independence were emphasized by residents, but family members needed to act as advocates. We also noted that the legal system emphasizes family control over individual decision making as competency declines with aging. Optimal personal decision making in the residents' best interest also became more difficult with loss of individual mental capacity. (shrink)

Studies have demonstrated that parents often exhibit a still face while silently reading their cell phones when responding to texts. Such disruptions to parent-child interactions have been observed during parental media use such as texting and these disruptions have been termed technoference. In the present study, we explored changes to mother-child interactions that occur before, during and after interruptions due to texting using an adapted naturalistic still face paradigm. Specifically, we examined the effect of an interruption due to either maternal (...) smartphone use or use of an analog medium on maternal interaction quality with their 20- to 22-month-old children. Mother-child interactions during free play were interrupted for 2 min by asking the mothers to fill out a questionnaire either by typing on the smartphone or on paper with a pen. Interactional quality was compared between free-play and interruption phases and to a no-interruption control group. Mixed ANOVA across phase and condition indicated that maternal responsiveness and pedagogical behavior decreased during the interruption phase for both the interruption groups but not for the no-interruption group. Children also increased their positive bids for attention during the paper-and-pencil and the smartphone conditions relative to the no-interruption control. These findings are consistent with a large body of research on the still-face paradigm and with a recent study demonstrating that smartphone interruptions decreased parenting quality. The present study, however, connects these lines of research showing the many everyday disruptions to parent-child interactions are likely to decrease parenting quality and that toddlers are likely to detect and attempt to repair such interruptions. Research on video game violence has focused on the impact of aggression, but has so far neglected the processes and mechanisms underlying the enjoyment of video game violence. The present contribution examines a specific process in this context, namely players' strategies to cope with moral concern that would arise from violent actions. Based on Bandura's theory of moral disengagement, we argue that in order to maintain their enjoyment of game violence, players find effective strategies to avoid or cope with the (...) moral conflict related to their violent behaviors in the game world. Exploratory interviews with ten players of violent video games revealed some relevance of moral reasoning to their game enjoyment, and several strategies that help players to ‘manage’ moral concern. Most importantly, respondents referred to the game-reality distinction and their focus on winning the game when explaining how violent action is a by-product of good performance. Findings are discussed in light of further theorizing on ‘moral management’ and potential links to the media violence debate. (shrink)

This case study provides a multi-perspective view on the power of political events as a strategy to influence public opinion-building regarding the European Union and the European Idea. To achieve this purpose, it examines one prominent political issue of 2007, namely the German Presidency of the Council of the EU. Looking at three different groups of actors, the German Government, the media, and the audience, the public perception of events is analyzed according to their varying degree of mediatization. The case (...) study compares the three main objectives of the German Presidency on the actors' agendas and describes how issues were framed during three different time periods. The findings suggest that the media agenda was heavily influenced by the government's scheduled events. Regarding the frames identified in the public sphere, the media offered different interpretations, somewhat varying from the political leaders' intentions and from the citizens' perceptions. ABSTRACTThe ability to evaluate scientific claims and evidence is an important aspect of scientific literacy and requires various epistemic competences. Readers spontaneously validate presented information against their knowledge and beliefs but differ in their ability to strategically evaluate the soundness of informal arguments. The present research investigated how students of psychology, compared to scientists working in psychology, evaluate informal arguments. Using a think-aloud procedure, we identified the specific strategies students and scientists apply when judging the plausibility of arguments and classifying (...) common argumentation fallacies. Results indicate that students, compared to scientists, have difficulties forming these judgements and base them on intuition and opinion rather than the internal consistency of arguments. Many problems that arise when providing pharmacy services may contain some ethical components and the aims of this study were to develop and validate a scale that could assess difficulties of ethical issues, as well as the frequency of those occurrences in everyday practice of community pharmacists. Development and validation of the scale was conducted in three phases: generating items for the initial survey instrument after qualitative analysis; defining the design and format of the instrument; validation of the instrument. The (...) constructed Ethical Issue scale for community pharmacy setting has two parts containing the same 16 items for assessing the difficulty and frequency thereof. The results of the 171 completely filled out scales were analyzed. The Cronbach’s α value of the part of the instrument that examines difficulties of the ethical situations was 0.83 and for the part of the instrument that examined frequency of the ethical situations was 0.84. Test–retest reliability for both parts of the instrument was satisfactory with all Interclass correlation coefficient values above 0.6,. The 16-item scale, as a self assessment tool, demonstrated a high degree of content, criterion, and construct validity and test–retest reliability. The results support its use as a research tool to asses difficulty and frequency of ethical issues in community pharmacy setting. The validated scale needs to be further employed on a larger sample of pharmacists. (shrink)

Benardete paradoxes involve a beginningless set each member of which satisfies some predicate just in case no earlier member satisfies it. Such paradoxes have been wielded on behalf of arguments for the impossibility of an infinite past. These arguments often deploy patchwork principles in support of their key linking premise. Here I argue that patchwork principles fail to justify this key premise.

When shared decision making breaks down and parents and medical providers have developed entrenched and conflicting views, ethical frameworks are needed to find a way forward. This article reviews the evolution of thought about the best interest standard and then discusses the advantages of the harm principle (HP) and the zone of parental discretion (ZPD). Applying these frameworks to parental refusals in situations of complexity and uncertainty presents challenges that necessitate concrete substeps to analyze the big picture and identify key (...) questions. I outline and defend a new decision-making tool that includes three parts: identifying the nature of the disagreement, checklists for key elements of the HP and ZPD, and a “think list” of specific questions designed to enhance use of the HP and ZPD in clinical decision making. These tools together will assist those embroiled in complex disagreements to disentangle the issues to find a path to resolution. (shrink)

What are the intellectual origins of the ecological crisis? Which approach can offer an alternative? In the first part of this paper, I argue that the crisis was caused not by faith in reason as such, but instead by distortions of reason. Further, I consider the intellectual prerequisites for ecological destruction, the ultimate cause of which can be seen in the transitional state of our civilisation from a dependent to an interdependent mode of interaction with the biosphere. This paper examines the impact of integrated reporting on the integration of environmental, social, and governance issues into the business model and the related economic and ESG performance changes. To investigate these internal and external transformational effects of IR, important differences between IR and alternative ESG reporting strategies are worked out. Using three matched samples of companies from around the world for the sample period 2002–2011, IR companies are matched with companies applying no ESG reporting, stand-alone ESG reporting, or ESG (...) reporting in the annual report. The results suggest that IR is a superior mechanism only for the integration of ESG issues into the core business model when comparing IR with the ESG reporting strategies of no ESG reporting and ESG reporting in annual reports. In comparison with, stand-alone ESG reporting, the results indicate that IR is negatively associated with the ESG integration level and with the economic and ESG performance. Moreover, this negative impact is lower for companies that have already implemented ESG management tools prior to the initiation of IR and is stronger for companies residing in countries with legal requirements for the disclosure of ESG information. A separate change analysis reveals that companies do not benefit from a switch from stand-alone ESG reporting to IR. Thus, this paper provides empirical evidence that contradicts the general notion of IR as a superior reporting mechanism, as the benefits of IR are driven by several factors. (shrink)

The article compares the famous fairy tale “Th e Snow Queen” by the Danish writer Hans Christian Andersen with a Soviet play of the same title by Evgenij Schwartz. Schwartz changed the original ideas and narrative structure of Andersen’s complex and religious text in order to make the play more attractive, spectacular and relatable for Soviet viewers. With the help of A. J. Greimas’ actantial model and semiotic square, the article tries to distinguish and analyse the discursive transformations of the (...) source text in the process of adaptation.В данной статье мы сравниваем знаменитую сказку Ханса Кристиана Андерсена ≪Снежная Королева≫ и одноименную пьесу, написанную советским драматургом Евгением Шварцем. We examine two competing solutions to Benardete paradoxes: causal finitism, according to which nothing can have infinitely many causes, and the unsatisfiable pair diagnosis (UPD), according to which such paradoxes are logically impossible and no metaphysical thesis need be adopted to avoid them. We argue that the UPD enjoys notable theoretical advantages over causal finitism. Causal finitists, however, have levelled two main objections to the UPD. First, they urge that the UPD requires positing a ‘mysterious force’ that prevents paradoxes from (...) arising. Since such a force is implausible, the UPD is in trouble. Second, they employ recombination or patchwork principles to argue that paradoxical situations would be possible if causal finitism were false. Since such situations are not possible, causal finitism is true, and so a substantive metaphysical thesis is needed to avoid the paradoxes. A prominent objection to the MOA is that it suffers from a symmetry problem: an exactly parallel modal ontological argument can be given for God's non-existence. Several attempts have been made to break the symmetry between the arguments. Academic integrity determines the trust that society has in the quality of education and the results of scientific research. More broadly, it influences honesty, respect for ethical principles, and the fair behaviour of society members. Accordingly, higher education institutions should have clear, transparent and well-communicated policies to defend academic integrity among all stakeholders. Taking into account the worldwide dependence on digital technologies, online communication channels should be also used for this purpose. Using qualitative content analysis, this paper aims to investigate (...) how academic integrity is framed by Latvian and Lithuanian state-financed universities in online public spaces in relation to the criteria of an exemplary academic integrity policy. Any worlds semantics for intentionality has to provide a plenitudinous theory of impossibility: For any impossible proposition, it should provide a world where it is true. Hence, also any semantics for impossibility statements that extends Lewis’s concretism about possible worlds should be plenitudinous. However, several such proposals for impossibilist semantics fail to accommodate two kinds of impossibility that, albeit not unheard of, have been largely neglected in the literature on impossible worlds, but that are bound to arise in the Lewisian (...) context. The proposals discussed here stop short of plenitude because they adhere to what Lewis occasionally referred to as ‘ontological truth’, as they lack the semantic ability to misrepresent ontological facts. The paper develops a framework for systematic misrepresentations on the basis of Mares’s situation-based account of impossible ‘worlds’, and which confines ‘ontological truth’ to possibility. It thus illustrates how a plenitude of impossibilities can be achieved. (shrink)

Reports of children participating in hunger strikes while detained in offshore detention centres raise interrelated ethical issues and recognizable challenges for the medical decision-makers at these sites. A composite case study, informed by reports in the public domain, is employed to explore the unique challenges of consent and decision-making in these circumstances and the perennial issues inherent in adolescents’ developing capacity and autonomy. We present an amalgamated case of a fourteen-year-old adolescent who refused to consent to medical reversal of her (...) hunger strike protest. The medical team became the final arbiter when her parents, who were also in detention, could not agree with each other even after mediation. The case explores the complexity of evaluating the adolescent’s capacity to provide informed consent while influenced by the opinions of co-detainees in this extreme setting. We argue that the parents and the child had compromised decisional capacity due to the effects of detention. The challenges to the medical team are recognized and discussed. The team members faced a difficult dilemma and considered the competing values of the multiple cultural and ethical factors. Each team member integrated his or her own roles, duties, and discipline-specific professional guidelines with the primary goal of mitigating potential harms. (shrink)

ABSTRACT This essay considers definitions of racism which emphasise its behavioural, motivational, and cognitive features. The behavioural definition (‘the failure to give equal consideration, based on the fact of race alone’) is rejected, primarily due to its inability to distinguish between ‘true’and ‘ordinary’racism. It is the former which is morally most objectionable — and which identifies the essence of the racist attitude and belief. The central part of the essay argues in favour of the motivational approach to the definition (‘the (...) infliction of unequal consideration, motivated by the desire to dominate, based on race alone’) and clarifies the way in which racism, thus understood, conflicts with the principle of human equality. Finally, the cognitivist definition (‘unequal consideration, out of a belief in the inferiority of another race’) is also rejected, despite its intuitive appeal. The overall discussion has important implications for moral philosophy. It is shown both that the principle of human equality does not strictly imply equal consideration, and that one may violate the principle of equal perception, yet not deny the principle which, from the perspective of this argument, is the more fundamental element in the principle of human equality, the principle of equal human worth. In transformation research of late, accounts on the relation between intentionality and agency on the one hand, and the more routinised and structured side of social co-existence on the other, are increasingly nuanced. However, we observe a deficiency in the way arguments are set up by the interlocutors: both, scholars who grant intentionality a central role and those who emphasise its limitations generally do so at the level of ontology – debating degrees of human capacity for conscious planning versus a (...) largely unconscious reproduction. We wish to shift this question from an ontological to a pedagogical one, exploring possibilities to cultivate and learn intentionality. We do so by developing the concept of consciousness-in-nature that we derive from, and contextualise in, the traditions of deep ecology and (Westernised) Buddhism which both view human beings as inseparable from nature and one another. With consciousness-in-nature we refer to an understanding of humans as a part of nature that has developed the capacity for (self-) reflection and deliberation – a capacity that is not static or firm but can be nurtured and cultivated or clouded over and subdued. From this standpoint, we lay out an understanding of the role of (re)learning consciousness for processes of social change and explore potentials for its nurturing. (shrink)

This paper examines whether and to what extent the overall business strategy influences the firm’s mismanagement of sustainability. Specifically, an empirical measure for the mismanagement of sustainability is developed by exploiting the newly available materiality guidelines for US firms to define industry-specific material sustainability issues. Using this measure, this paper shows that mismanagement of sustainability can represent unethical business behavior when firms intentionally perform better on immaterial issues than on material issues by diverting stakeholders’ attention from the firm’s low overall (...) sustainability performance. This paper assumes that the right business strategy can prevent such unethical actions. Based on Miles and Snow’s organizational theory, this paper distinguishes between Prospector and Defender business strategies. By employing multiple firm-level panel regressions, the findings suggest that Prospector-type firms are more likely to mismanage sustainability issues compared to Defender-type firms intentionally. The results give implications for researchers, regulators and standard setters, auditors, sustainability practitioners, and scholars. (shrink)

ZusammenfassungWie ist die Auswahl zukünftiger Kinder in moralischer Hinsicht zu beurteilen? Der Beitrag untersucht diese Frage auf der Basis eines liberalen Prinzips der reproduktiven Freiheit, welches Handlungsspielräume und Privatsphäre in Fragen der Fortpflanzung verteidigt, wenn nicht gewichtige moralische Gründe aufgezeigt werden können, welche den Handlungen der beteiligten Personen Grenzen setzen. Er beschränkt sich auf die negative Auswahl, d. h. die Auswahl von gesunden Kindern anstelle von zukünftigen Kindern mit Behinderung oder gesundheitlicher Beeinträchtigung. Erörtert werden selektionsbefürwortende Überlegungen, welche das Wohlergehen des (...) zukünftigen Kindes in den Fokus rücken, und zwei grundsätzlich selektionskritische Argumente. Das erste verweist auf parentale Tugenden, welche mit der Auswahl zukünftiger Kinder unvereinbar wären. Bei dem zweiten handelt es sich um den Einwand der Diskriminierung von Menschen mit Behinderung. Das Ergebnis der Diskussion ist, dass es zukünftigen Eltern in den meisten Fällen freisteht, die Entscheidung über die Auswahl ihrer Kinder im Licht ihrer Ziele und Werte zu treffen. (shrink)

Durch Migrationsprozesse und zunehmenden Pluralismus ist in Deutschland das Thema „kulturelle Diversität“ in der Medizin aktueller denn je. In der medizinischen Fachliteratur und im gesellschaftlichen Diskurs wird vermehrt von interkulturellen Konflikten im Kontakt zwischen Arzt und Patient berichtet, was die Frage nach der Rolle von Interkultureller Kompetenz für die klinische Praxis aufwirft. Zunächst widmet sich der Beitrag kritisch den verschiedenen Auffassungen des Begriffs „Kultur“ im medizinischen Kontext, um anschließend eine Methode der interkulturellen Philosophie als eine Möglichkeit für eine kultursensitive Ethik (...) zu skizzieren. Anschließend wird aufgezeigt, welche Schwierigkeiten mit dem Begriff der Interkulturellen Kompetenz verbunden sind und weshalb die Autoren diesen trotzdem als unerlässlich für die Wahrnehmung potentieller Konfliktfelder als auch für den Umgang mit diesen erachten. Schließlich werden derzeitige Entwicklungen in der medizinischen Ausbildung sowie konkrete Beispiele für eine kultursensible Ethikberatung illustriert. Es zeigt sich, dass international zahlreiche Ausgestaltungen Interkultureller Kompetenz in Form von Leitfäden und konkreten Schulungsmodulen existieren, aber auch, dass es in Deutschland an konkreten Umsetzungen in der Breite mangelt und die Zusammenarbeit wissenschaftlicher Disziplinen sowie der betroffenen Institutionen derzeit noch ausbaufähig ist. The purpose of this article is to discuss the criminalization of conduct based on human dignity arguments. It proposes a modest version of integrating human dignity into discussions about criminalization. After a critical examination of both the notion of “human dignity as an objective value” and the assumption that the meaning of human dignity can be explained by referring to Kant’s moral philosophy, human dignity violations are characterized as severe humiliations.

In this paper, I distinguish three claims, which I label individual intentional autonomy, individual intentional autarky, and intentional individualism. The autonomy claim is that under normal circumstances, each individual's behavior has to be interpreted as his or her own action. The autarky claim is that the intentional interpretation of an individual's behavior has to bottom out in that individual's own volitions, or pro-attitudes. The individualism claim is weaker, arguing that any interpretation of an individual's behavior has to be given in (...) terms of individual intentional states. I argue that individual intentional autonomy implies neither individual intentional autarky, nor intentional individualism, with which it is usually lumped together. I further argue that this insight is the key to an adequate view of an important class of actions, i.e., plural actions. The dominant theory of elite power, grounded in Weberian bureaucracy, has analyzed elites in terms of stable positions at the top of enduring institutions. Today, many conditions that spawned these stable ‘command posts’ no longer prevail, and elite power thus warrants rethinking. This article advances an argument about contemporary ‘influence elites’. The way they are organized and the modus operandi they employ to wield influence enable them to evade public accountability, a hallmark of a democratic society. Three cases are presented, (...) first to investigate changes in how elites operate and, second, to examine varying configurations in which the new elites are organized. The cases demonstrate that influence elites intermesh hierarchies and networks, serve as connectors, and coordinate influence from multiple, moving perches, inside and outside official structures. Their flexible and multi-positioned organizing modes call for reconsidering elite theory and grappling with the implications of these elites for democratic society. (shrink)
